专利流氓是市场经济的产物,它的存在和发展符合市场竞争规律。专利流氓是专利运营模式的一种大胆的创新,美国出现了像高智发明和Vringo这样的专利流氓公司以及大量的专利诉讼案件,证明了其强大的生命力。本文用“鲶鱼效应”理论,从专利流氓激励专利运营、盘活专利资源和提高企业创新能力的视角阐述专利流氓的正面影响。本文最后建议我国中小企业面对专利流氓时应该持有辩证和理性的态度,并建议我国立法、司法和行政机关协同合作来制约专利流氓滥用专利权利的现象。

Patent Trolls are the product of a market economy, its existence and development in line with market rules of competition. Patent Trolls are bold and innovative business model patents, the United States emerged as an intellectual inventions and patents Vringo such rogue companies and a large number of patent litigation cases, it demonstrated its strong vitality. In this paper, "catfish effect" theory, motivation patent from the patent rogue operators, utilizing patent resources and enhancing innovation capability perspective elaborated positive impact of patent rogue. Finally suggestion of SMEs in the face of rogue should hold the patent dialectical and rational manner, and suggestion of legislative, judicial and administrative authorities collaborate to restrict the abuse of patent rights patent rogue phenomenon.
