高智发明是全球著名的专利投资公司,开启了一种全新的专利商业运营模式,并取得了巨大的成就,但其作为投机型NPE的典型代表,因滥用专利诉讼以及阻碍科技创新也受到了广泛的诟病。近年来,高智发明的运营模式悄然发生了变化：削减专利购买基金规模,放慢专利收购步伐,调整基金构成,加强自主研发力度,设立专利技术孵化器,并重点开展“协助研发”模式。本文研究高智发明的新运营模式及特点,探究其在我国运营的调整方式,并分析其运营模式发生变化的原因,以期对我国专利运营模式的建设有所启示,并提出相关建议。

Intellectual Ventures(IV) is a globally famous patent investment company, and it opens a brand new patent business operation model and makes great achievements. However, as a typical representative of speculative NPE, IV has also been widely criticized by abusing patent litigation and hindering scientific and technological innovation. In recent years, the business model of IV has be changed quietly: reducing the size of the IIF, slowing down the pace of patent acquisition, adjusting the fund composition, strengthening independent research and development,setting up a patent technology incubator,and focusing on "Original Research and Development" mode. This paper studies the new operation mode and characteristics of IV,exploring the ways of its operation in China, and analyzing the reasons for the change of its operation mode in order to attain enlightenment for the construction of the patent operation mode in China and put forward some suggestions.
