绿色建筑合同能源管理模式在实现绿色建筑运营价值方面的优越性已引起高度重视。在分析既有合同能源管理模式的特点和不足基础上,借鉴合同柔性在应对投资、信誉等不确定性风险的补偿调整权利优势,提出基于合同柔性的绿色建筑合同能源管理模式。通过引入合同柔性重新构建合作框架、设计合同条款,形成关系维度的合同治理,以刚性与柔性条款的合理配比形成绿色建筑合同能源管理市场化运作新格局,以风险与收益合理分摊原则实现整体利益最大化。

The advantages of the green building contract energy management model in realizing the value of green building operations have drawn great attention.
