在当前如火如荼的技术变革进程中,政府的监管措施和相应法律框架由于存在滞后性而无法匹配新兴技术和商业模式的发展要求,在一定程度上对创新造成了阻碍。面对监管政策与创新发展之间的矛盾,一些国家的政府开始采取各种形式的“创新试验”制度,其中“现实实验室”就是德国政府给出的解决方式。本文详细介绍了现实实验室的定义和构建方式,并通过具体案例展示现实实验室在实践中的应用方式。最后为中国开展相关创新试验提出3点建议。

In the current process of technological transformation, the government"s regulatory measures and corresponding legal frameworks cannot match the development requirements of emerging technologies and business models due to the lag, which has hindered innovation to a certain extent. Faced with the contradiction between regulatory policies and innovation development, governments in some countries have begun to adopt various forms of "innovation experiment", of which the "Real Laboratory" is the solution provided by the German government. This article introduces the definition and construction method of the real laboratory in detail, and shows the application of the real laboratory in practice through a specific case. Finally, three suggestions are put forward for China to carry out relevant innovation experiments.
