经济高质量发展需要完善普惠制度,作为特惠区域,自贸区是完善普惠制度的重要立足点和载体。在探索、实践和推广进一步扩大开放以及改善营商环境的现代市场经济制度的进程中,自贸区知识产权制度是关键点。本文站在特惠与普惠的视角,以马克思主义观点阐述了特惠与普惠关系的内在逻辑,并在此基础上进行知识产权制度创新的理论分析,认为当前自贸区知识产权制度实施的困境突破,不仅要考虑自贸区的特惠性需求,更要着力于制度创新的普惠性。知识产权立法完善应在积极融入全球知识产权新秩序的基础上进行本土化建构,知识产权执法水平统筹推进以及知识产权海外维权和扩展能力提升的同时,应以自贸区为契机,在全国范围内逐步形成知识产权保护的文化。

High-quality economic development needs to improve inclusive system. As a preferential area, free trade zone (FTZ) is an important foothold and carrier for improving inclusive system. The intellectual property system of FTZ is the key point during the process of exploring, practicing and popularizing the modern market economic system of further opening up and improving the business environment. From the perspective of preferential and inclusive demand, this paper expounds the internal logic of the relationship between preferential and inclusive demand based on Marxist, and then makes a theoretical analysis of intellectual property system innovation. It is considered that the breakthrough in the implementation of intellectual property system in FTZ should not only consider the preferential demands of FTZ, but also focus on the inclusiveness of institutional innovation. The improvement of intellectual property legislation should be localized on the basis of actively integrating into the new global intellectual property order, and the level of intellectual property law enforcement should be promoted as a whole, while the overseas rights protection and expansion ability of intellectual property should be improved. What’s more, the FTZ should be taken as an opportunity to gradually form a culture of intellectual property protection nationwide.
