协同创新成果知识产权归属风险及其控制

Risk and Control of the Intellectual Property Ownership in Collaborative Innovation Achievement

摘要:

协同创新是国家在新时期顺应时代发展要求提出的具有重大战略意义的创新型计划。在总结合作创新等经验的基础上，通过调查研究，发现协同创新成果在知识产权归属方面面临着三类风险：学术论文发表，研发成果被公知；合作协议不完备，研发成果被私有；协同创新中心保护不力，研发成果被窃取。防范和控制上述风险主要应做好改革高校单一科研评价体制、增强合作协议的完备性、完善与落实“一奖两酬”制度、完善协同创新中心内部管理机构和强化知识产权保护意识等五个方面工作。

Abstract:

Collaborative Innovation is the country’s innovative plan in the new period which follows the development of times and has important strategic significance. Based on the experience of Cooperative Innovation, this paper found that collaborative innovation achievements are facing with three kinds of risks through the investigation: publishing academic papers which leads to the research results become public knowledge; incomplete cooperation agreements resulting in research results becoming private property; weak protection of the collaborative innovation center, which leads to the research results are stolen. Preventing and controlling the above-mentioned risks mainly should do as the followings: (1)reforming colleges’ single scientific research evaluation system; (2)strengthening the completeness of cooperation agreement; (3)improving and implementing the system of "one prize and two rewards "; (4)improving the internal management mechanism of the cooperative innovation center; and (5) strengthening the protection consciousness of intellectual property.
