生物质能国内碳汇市场构建的法律思考

摘要:

为使国内生物质能产业摆脱目前普遍存在的经营亏损困境,我国现有文献将思路集中于降低生物质能产业成本和转嫁经营负担两方面。但是忽视了生物质能生产活动本身所具有的环境效益之变现问题。确认生物质能碳汇的法律属性并将生物质能碳汇纳入国内碳交易试点,以实现生物质能环境效益之变现,这是通过市场机制对生物质能产业实现生态态补偿的较好方式,是解决该产业发展困境的一条新出路。

Abstract:

To solve the operational losses plight of domestic biomass energy industry ,which is the common plight at present,the existing researches focus on how to reduce production cost and shift operation burden.However,to cash the environmental benefits ,which the production activity of biomass energy has,has been ignored.In order to cash the environmental benefits of biomass energy,we should affirm the legal attribute of biomass energy carbon sequestration and insert it into pilot project for the domestic carbon trading,which is a good way to realize the permanent compensation for the loss of biomass energy industry by market mechanisms and a new way to solve the development plight of the industry.
