论创意的著作权法保护---对思想与表达二分法的重新解读

摘要:

创意的著作权法保护问题一直以来都受到著作权法上的思想表达二分法原则的阻扰,导致在司法实践中创意常常被归入了思想的范畴而排除在著作权保护范围之外。本文从创意的概念及其特征入手,并介绍了目前创意的几种法律保护模式及其弊端,进一步阐释了著作权法保护创意的必要性,并通过对思想与表达二分法原则的重新解读,为创意纳入著作权法保护范围提供了法律依据。最后,为创意设计特殊的著作权保护制度,以期为将来的立法和司法实践提供参考。

Abstract:

For a long time, the protection of originality by Copyright Law is obstructed by the Idea-Expression Dichotomy Principle; for this reason, originality is always classified as “idea” and thus is excluded from the protective scope of Copyright Law. This paper starts from the concept and features of originality and introduces several current law protection modes and their drawbacks; then it further elucidates the necessity of originality protection by Copyright Law, and provides legal basis for originality to be included in the protective scope of Copyright Law through re-interpretation of the dichotomy of idea and expression. At the end this paper points out that particular copyright protection system should be designed for originality protection, in order to provide references for future legislation and legal practice.
