基于技术创新的高校知识产权确权制度研究

摘要:

一项资源实现其价值需要满足边界清晰和产权明确等条件,[1]技术变革缓慢的主要原因在于未能创新一整套所有权。［2］知识产权确权就是确定知识财产的所有权归属。高校知识产权确权是检验其技术创新能力的关键指标。本文分析了职务技术成果、财政资助项目技术成果、协同创新技术成果、在校学生技术成果权利归属确定的法定原则,更针对高校提出相应的创新性的权属制度规则,以期高校创新和完成人权益的双赢。

Abstract:

Taking considerations of clear boundary, clear property rights and other vital conditions can be the access to realize the values of resources. The major reason which leads to slow development of Technology Revolution is that the inabilities of innovating in a novel series of ownership. Besides, it is academic intellectual property rights that can be a pivotal indicator to test the technological innovation ability of intellectual property rights, which is to confirm the ownership attribution. Having analyzed piles of factors in this dissertation, which includes job related technological achievements, project supported by the financial and technological achievements, collaborative innovation and technological achievements and the statutory principle of student rights of technical achievements identified, the author even came up with some ownership rules of innovation which aims at colleges and universities so that they can innovate and accomplish human rights.
