中国高校专利许可的时滞问题?

Research on Patent License Delay of Chinese Universities

摘要:

专利许可交易是高校实现专利利用的首要方式，而专利申请在公开之后往往还需要继续等待交易时机。通过对中国高校350个专利许可交易的考察，发现专利审查期限与专利许可时滞呈正相关，专利类型对专利许可时滞有显著影响，交易对象是否在同一区位对专利许可时滞具有显著影响，而是否为校企合作完成的专利对专利许可时滞没有显著影响。基于此，提出促进我国高校专利许可交易的若干建议。

Abstract:

Patent licensing is the primary way for universities to utilize patent. It is usually needed to wait for the trading opportunity after a patent application is published. Based on 350 universities patent licensing transactions, it is found that patent examination period is positively related to patent licensing delay. Type of patent has significant impact on patent licensing delay; whether the trading partner is in the same area as the patentee has significant impact on patent licensing delay; while whether the patent is school-enterprise cooperated has no significant impact on it. And recommendations are given based on these finding to promote universities’ patent licensing deals.
