Abstract:We used the trend method and the structure analysis method respectively to analyze the application changes of the three types of patent that are invention, utility model and design based on the statistic data of patent application in China which is from 1985 to 2013 and then used Wilcoxon signed rank test method to research the market motivation and behavior of Chinese applicants. The research results show that the revision of the Chinese patent law has significant impact on the patent application behaviors; the degree of marketization of China"s patent applications improves soon recently and the China"s patent applicants’ behaviors have been gradually transformed to a market driven as well as business oriented; the amounts of the three kinds of patent application in China that are invention, utility model and design are roughly equal, but the number of utility model is biggest, invention is medium, design is smallest; China’s patent innovation ability is promoting quickly, but is still insufficient, invention patent can have large gap to be developed.
