摘要:

“中国制造”创新驱动发展模式的确立表明了我国制造业发展在新阶段的新定位,这对原有相关法律制度提出了挑战,需要进行法律制度创新予以保障与支持。美国和德国关于保障和促进制造业创新发展的法律体系具有借鉴意义。构建中国的制造业创新驱动法律保障体系,应该在坚持“绿色创新优先”和“高端产业与基础产业并举”原则下,创设和重构相应法律制度。
