国外绿色专利快速审查制度及其对我国的启示

The Fast Examination System of Green Patents in Foreign Countries and the Implications for China

随着全球气候变暖和生态环境不断恶化,绿色技术不断发展。为了促进绿色技术的发展和创新,绿色专利快速审查制度已为多个国家所采用。但是各国的绿色专利快速审查制度在主体资格、审查范围和程序、实施效果等方面都有所不同。本文以英国、韩国、美国、日本为例,介绍和分析了这些国家实施绿色专利快速审查制度的现状并总结出其优缺点,并结合我国现状对完善我国的绿色专利快速审查制度提出建议。

Abstract:

With the warming of the earth and the continuously global deteriorating of the eco-environmental problems, green technology is developing gradually. In order to promote the development and the innovation of green technologies, the fast examination system of green patents has been adopted by many countries. But the fast examination systems of green patents of many countries are different from each other especially in the subject qualifications, the examination scopes and procedures and the effects of its implementation. This article takes the United Kingdom, the United States, Korea and Japan for examples, describing and analyzing the present situations of the fast examination systems of green patents of those countries. Then this article sums up the advantages and disadvantages of the fast examination system of green patents and gives some suggestions to perfecting the fast examination system of green patents of China by combining the current situations of China.
