数字出版的著作权法律保护难题与解困途径

Problems and solutions on the Copyright Law protection of Digital Publishing

摘要:

技术进步与法律完善存在着逻辑上的互动性与历史上的关联性，数字出版技术的应用，对现行著作权制度带来了巨大的冲击，导致了传统著作权权利规定的模糊、侵权防控的乏力和许可模式的失效等问题，同时数字出版产业自身也不断遭遇著作权法律保护的危机。为此，应当创新数字出版著作权授权模式促进合法传播，并及时出台司法解释与管理规章完善现行制度规范，在此基础上可进一步探索著作财产权体系化建构提升法律适应性，以促进数字出版产业的健康有序发展。

Abstract:

With the logically interactive and historical relevance between technological progress and law revision, the application of digital publishing technology, has brought huge impact to current copyright system, leading to the traditional copyright rights provisions ambiguity, Prevention system invalidation, licensing model failure and other problems, while the digital publishing industry also faced with the problems on the Copyright Law protection. Therefore, it should make innovation of the digital publishing copyright authorization model to promote transmission legally, issue judicial interpretation and management regulations to strengthen the rules timely, and then on this basis explore the systematic construction in economic rights system of Copyright Law to promote the healthy and orderly development of the digital publishing industry effectively.
