“生态红线”实施的制约性因素分析及制度完善

摘要:

“生态红线”作为对空间环境实施生态整体性保护的一项创新举措，在落地过程中还存在诸多制约性因素，具体表现为：概念界定不清、专门法律缺失、划线范围有争议、多头管理致红线空间重叠、生态补偿和绩效考核等配套制度不完善等弊端，导致生态红线“难落地”。未来制度的完善，应当在制度安排符合生态整体特性的思路指引下，采取多种手段保障红线落地，具体措施如下：在科技划定红线区域的前提下，通过国家和地方专门立法予以保线；实施分类分级的管控措施进行护线；配套设置生态补偿、绩效考核、公众参与以及立体化空间监管体系等制度坚实守线。只有通过多种管理手段的统筹推进，才能保障生态红线“划的好”、“守的住”，实现建设生态文明社会的目标诉求。

Abstract:

:“Ecological red line”,as an innovative measure to implement ecological integrity protection in China"s space environment,there are many restrictive factors in its landing.The detailed performances are: indistinct definition,the absence of the legal system,demarcation dispute,multiple management leading to the overlap of red line,the faultiness of the relative systems of ecological compensation and performance appraisal and so on,etc,which cause red line difficulty of landing.In the future to improve the system,should be under the guidance of the institutional arrangements in line with the overall characteristics of the ecological,the specific measures include: under the scientific and technological means to distinguish ecological function supervision,on the basis of system of rational index and correction of social investigation,use the scientific calculation model to calculate the red line area.Then,through promulgating national and local special legislation to protect the line ,conducting classification and gradation control measures to care the lines,setting up the ecological compensation,performance appraisal, public participation and three-dimensional space monitoring system and so on to defend the line,only in this way can we ensure the ecological red line’s “Stroke well,keep in good condition”.To achieve the goal of building ecological civilization.
