中国企业面向中亚国家贸易的知识产权保护困境与对策分析*

内容：知识产权制度作为一种产权安排机制,它使得创新成果拥有可量化的市场价值,使创新者在法律的保护下拥有创新成果的收益,并以此来规范创新成果的市场交易。随着知识产权的日益商品化,无论货物贸易产品、服务贸易还是以专利技术、商标为主要客体的转让和许可贸易,都与知识产权息息相关。于是在“丝绸之路经济带”建设中,在加强贸易畅通过程中,在技术交易、跨国并购、研发投资等方面重大经济活动中均可能涉及知识产权交易、知识产权保护、知识产权诉讼、知识产权鉴定和评估等方面问题。因此,为推动与中亚国家间的国际贸易,应认知“丝绸之路经济带”建设中的知识产权贸易的困境,重视“丝绸之路经济带”建设中面向中亚国家的知识产权贸易对策。

As a property right mechanism, intellectual property makes the innovations be a quantifiable market value, and make the innovators to get innovations proceeds in the legal protection which regulate the marketing of innovations. With the growing commercialization of intellectual property rights, whether goods trade, services trade and the transfer and licensing of trade based on patented technology and trademarks as the main object are closely related to intellectual property rights.
