基于公共领域理论的传统医药知识及相关资源保护

摘要:

本文以知识产权法的公共领域理论为视角，讨论了公共领域知识的特征、权益主体、利益原则，结合国际知识产权制度框架下传统医药知识的公共领域属性和法律地位，对传统医药知识及相关资源保护的策略进行了分析。思考和梳理了我国传统医学知识及相关资源保护的制度架构与缺陷。文章提出，在经济和文化全球化的背景下，政府需要采取相关措施，努力争取我国传统医药和相关资源在国际知识产权体系中的法律地位和知识权益，实现中医传统知识与现代科学及国际医药知识体系的对接，促进传统医药知识的保护与发展。

Abstract:

With the perspective of the theory of Public Domain of intellectual property law, this article discusses the characteristics, equity and benefits principle of traditional medical knowledge. Combined with analysis of the protective measures and effect of traditional medical knowledge constructed in some countries, Reviewing the protection framework and defects of Traditional Chinese Medical (TCM）knowledge and related resources in China, the article puts forward that the nation needs to take measures to strive for the legal status and rights of TCM and related knowledge in the international intellectual property system, in order to facilitate the connection between TCM and modern science and international knowledge system, and to promote the development of traditional Chinese medicine under the background of economic and cultural globalization.
