完善知识产权制度环境 提升我国创新主体的创新能力

Improving Chinese Innovators’ Innovation Ability by Perfectingthe IP System Environment

摘要:

根据《国家创新驱动发展战略纲要》,我国的创新主体主要包括企业、科研院所、高校、社会组织等。提升我国创新主体的创新能力意在解决我国在科技创新方面的弱势地位问题。通过完善我国知识产权制度环境来提升我国创新主体的创新能力,需要针对知识产权创造、运营、保护和管理制度中不适应创新经济关系要求的部分探讨相应的完善对策。具体包括以下四个方面的完善对策：一是完善知识产权创新人才培养与激励环境,二是完善知识产权运营环境,三是完善知识产权保护与共享环境,四是完善知识产权利益分配管理制度环境。

Abstract:

According to “National innovation driven development strategy”, Chinese innovators mainly include enterprises, scientific research institutes, Universities, social organizations and so on. The purpose of improving Chinese innovators’ innovation ability is to solve the problem of Chinese weak position in innovation of science and technology. In order to improve Chinese innovators’ innovation ability by perfecting the IP system environment, it is necessary to explore corresponding improvement countermeasures against four non-adaptive parts which can not meet the requirements of economic relations of innovation within the creation system, the operation system, the protection system and the management system in Chinese IP system. The improvement countermeasures include four aspects: first is to perfect the environment of training and encouraging innovation talents of IP, second is to perfect the environment of operating IP, third is to perfect the environment of protecting and sharing the IP, fourth is to perfect the environment of interests’ distribution management system of IP.
