专利标准化演化核心问题分析

随着知识经济时代的到来,专利与技术标准之间的传统界限被打破,二者迅速实现融合。但是专利成为标准之路并不是一帆风顺的,在专利逐渐向标准演化的过程中会遭遇诸多问题。本文以专利标准化为切入点,基于专利标准化演化的特点,将其分为：专利角逐标准、专利影响标准、专利占领标准、专利垄断标准四个演化阶段。并尝试从技术、市场、管理、政策、法律五大层面分析与探讨专利在标准化演化进程中的存在的核心问题,以期为专利标准化的顺利演化提供一定的理论指导。

Abstract:

WithStheSadventSofStheSeraSofSknowledgeSeconomy, the traditional boundaries betweenSpatent and technical standard have disappeared, which makes patent and technical standard realize fusion. But it is not easy for patents to be standards, and there are lots of problems during the evolution processes about patent standardization. The article divides the evolution processes about patent standardization into four stages, patent racing standard, patent impact standard, patent occupying standard, and patent monopolizing standard, based on the characteristics of the evolution about patent standardization. And it also tries to explore the coreSissues in evolution processes about patent standardization from five aspects, technology, market, management, policy and law, in the hope of providing theoretical guidance for pushing evolution processes about Patent Standardization.
