中国高铁“走出去”的知识产权联盟机制研究*

摘要:

中国高铁“走出去”的知识产权战略实施机制有个体化的反遏制机制和标准化机制之争,但根据中国高铁国家主导的多方协同创新模式,集勘察设计、建筑施工与装备制造、运营管理于一体的体系化模式,以及知识产权联盟的助推力,应当建立知识产权联盟作为中国高铁“走出去”知识产权战略的实施机制。建立中国高铁“走出去”的知识产权联盟应当以“共享成果,持续创新”为理念,主管部门主导,建立基础性的国内知识产权联盟,进而发展成国际知识产权联盟,并且当前的国内知识产权联盟应当以“公司制”为组织管理形态。

Abstract:

Intellectual property strategy implementation mechanism of "Going out" of China"s high-speed rail has controversy between anti-contain mechanism and standardized mechanism, but according to state-led multilateral cooperative innovation mode, reconnaissance and set design , construction, equipment manufacturing, operation management in the integration of complete sets of technology mode, and boost of intellectual property alliance ,“going out” of China"s high-speed rail should let the intellectual property alliance as implementation strategy mechanism .To establish intellectual property alliance of China"s high-speed rail should be based on "sharing achievement, continuing innovation" as the idea, boost of departments, to establish a basic domestic intellectual property alliance, then develop into the international intellectual property alliance, and the current domestic intellectual property alliance should be based on "the company" as the form of organization and operation mechanism.
