抽象思想例外原则是专利法的一项基本原则。当一项技术方案涉及抽象思想与具体技术的结合时，必须明确如何判断技术方案的可专利性。在这一过程中，应当脱离传统专利法物质变化为基础的分析方法，分析技术方案本身的可专利性。在抽象思想与具体技术的结合中，应当以技术方案自身逻辑的考查为起点，通过判断所涉及的抽象思想在方案中的角色，区分抽象思想具体化的两种方式：抽象思想的实现与抽象思想的应用。在这种区分的基础上对技术方案的可专利性进行判断。

Abstract:

Aabstract idea exception principle is a basic principle of the Patent Law.In the context of the combination of abstract idea and technical solution, we must determine how to determine the patent eligibility of an invention. We should break away from the traditional theory of patent law,which based on the physical nature of an invention, so as to analyze eligibility of the technical solutions. There are two paths when abstract idea was combined with technology solution: the implement of an abstract idea and the application of an abstract idea. On the basis of this distinction, by analyzing the logic construction of the invention,the patent of the technical scheme is judged.
