专利运营模式发展研究及其在国内外运用的对比分析

摘要:

对专利运营的概念、方式和作用进行阐述，对比专利运营模式与平台的国内外现状，梳理我国专利运营目前存在的问题并提出建议。总结得出目前专利运营的几种重要方式：市场化下的专利运营、政府参与的专利运营、联盟专利运营、专利交易平台等。目前专利货币化逐渐成为商业实践的一种模式，而在全球范围内，专利资产的利用明显存在不足。现阶段我国对专利价值的理解存在偏颇，面临着海外诉讼的风险、核心与外围专利的隐患及运营单一等问题，未来应该从增加专利存量、增强专利保护、加强专利布局、培养专利人才、提供专利资金等方面改进专利运营。

Abstract:

This paper systematically expounds the concept, mode and function of patent operation, and compares domestic and foreign patent operation pattern and platform, to analyze the exiting problems and propose directions for improvement. It introduces several current important patterns of patent operation, such as marketization mode, government-led pattern, alliance patent operation, patent trading platform and so on. Patent monetization gradually becomes a routine business practice, however, the effective use of patent assets deficiency is almost a global problem. At present, the understanding of patent value is biased, facing the risks of overseas litigation and the hidden dangers of core and peripheral patents, while the patent operation pattern is relatively simple. The future directions of patent operation are increasing patent stock, enhancing patent protection, strengthening patent layout, cultivating patent talents and providing patent funds.
