The Protecting of Proprietary know-how in Traditional Chinese Medicine#$NL Based on the Theories of Property and Duty

摘要:

在中医药知识产权体系中，鉴于其权利内容处于不公开状态，中医药技术秘密无论在权利性状还是在权利生成上都有欠清晰，因此法律对其属性的界定不能完全比照传统知识产权的立法逻辑，综合运用权利规则和义务规则，确认中医药技术秘密财产权的内在品质成为完善其制度保护的前提。相应的，法律有必要从中医药技术秘密自身权利范围的界定和权利生成的外部因素两个角度，检视其保护要求；从权利规则和义务规则两个层面，拓清其保护模式。

Abstract:

In the area of Intellectual property (IP) of Chinese Medicine (CM), both the structure and the formation of know-how of CM are obscure due to its state of secrecy. The legal nature of know-how of CM is different absolutely from the other rights in IP. Accordingly, it becomes important to use both the theory of property and the theory of duty to affirm its structure and formation. It is necessary to define the scope and contents of proprietary know-how of CM under the direction of those two theories, which is the basis of building the protection pattern of this kind of rights in IP
