法律激励理论视角下我国专利池的法律规制完善

The Legal Modification on Patent Pool from the Perspective of Legal Incentive Theory

摘要:

专利池作为一种现代技术产业发展应运而生的产物,其对当前的国际市场竞争具有举足轻重的作用。将法律激励理论与专利池制度相结合,在法律激励视角下结合我国对专利池的法律规制,运用法律激励措施,引导与促进专利池中成员持续创新的积极性,带动专利池的良性发展。专利池具有与单一专利权许可不同的法律性质,在肯定专利池鼓励竞争与创新、提升质量的正向价值基础上,我国现行法律也应该进行适时调整,扩大专利池激励对象、激励范围与改变激励路径,进一步完善对专利池法律规制的具体规则,为科学发展和技术进步提供更加优良的法制环境。

Abstract:

With the increase of modern economic growth depends more on technology and knowledge, Patent pool, as a new product of modern technology plays a critical factor in the competition of international market. From the perspective of legal incentive with Patent pool,legitimate rules can guide and stimulate pool members’ motivations to innovate sustainability and keep the development of pools. Patent pool has the special legal characteristics differ from single patent licensing agreement. Therefore, the positive values which lie in the patent pool are not only to encourage innovation and creation, but also to enhance the quality of patents. These should be protected. Under the perspective of legal incentive theory, the provisions governing the patent pool in Chinese modern law need to be modified in order to set a sounding legal basis for the development of science and technology.
