Abstract:The application of different patent types is a crucial part of the patent strategy, which is of great significance to the innovation activities and industry competition of enterprises. Based on the micro-data of Chinese industrial enterprises, this paper studies invention and utility model patent applications, and analyzes the impact of firm size, market competitiveness and R&D intensity on patent applications by constructing a bi-probit model. The results show that firm size and industrial concentration promotes both invention and utility model patent applications, which has a greater influence on invention patents. Moreover, high R&D intensity is positively related to invention patents, while negatively related to utility models. On this basis, this paper proposes suggestions on the patent strategy of corporates and policy recommendations for the reform of China's patent system.
