著作权法的发展史与科技进步具有十分紧密的关系。随着科技的发展，人工智能创作物高度类似于人类作品而引起广泛关注。面对人工智能创作物出现的新问题，要求著作权法进行回应和创新。本文首先介绍学界对人工智能创作物的热议；然后从作品属性及独创性等视角，分析现阶段人工智能创作物获得版权保护的多重障碍；最后分析对人工智能创作物保护的必要性，并分别对保守型保护模式和激进型保护模式进行深入论述。

Abstract:

The history of copyright law has a close relationship with scientific and technological. With the development of science and technology, artificial intelligence generated works is highly similar to human works and has attracted widespread attention. In the face of new problems arising from artificial intelligence creation, copyright law is required to respond and innovate. This paper analyzes the multiple obstacles to the copyright protection of artificial intelligence generated works crops from the perspective of works properties and originality. Then the paper analyzes the protection necessity and protection mode of artificial intelligence crop, hoping to have some reference meaning and reference value.
