Intellectual property rights sharing in biotechnology——the choice of public policies under three-dimensional rationality

随着知识经济和生物技术的迅猛发展,生物技术研发成为知识产权产生的重要领域。由于研发周期长、环节多、涉及关联知识产权多,目标品种的培育和生物技术产业的发展对促进信息分享、知识流动、技术转移的制度创新提出了更高要求。追寻知识产权公共政策的理性精神,借鉴主要发达国家知识产权政策演变中的理性设计,剖析我国生物技术知识产权共享的理性诉求,探讨我国生物技术知识产权的公共政策选择,将对提高生物技术研发投入效率和知识产权运营管理水平带来新的启发。

Abstract:

Biotechnology research and development has become an important area of intellectual property, as the rapid development of knowledge economy and biotechnology. Due to the long development cycle, too many approval links, and related intellectual property rights, the cultivation of target varieties and the development of biotechnology industry put forward higher requirements on institutional innovation to promote information sharing, knowledge flow and technology transfer.Based on pursuing the rational spirit of intellectual property public policy and learning the rational design on the evolution of intellectual property policies of major developed countries, this study analyzed the rational appeal and explored the choice of public policies of Chinese biotechnology intellectual property, which will bring new inspiration to improve the efficiency of biotechnology R D investment and the level of IP operation management.
