我国科技创新服务平台知识产权风险及其对策

On Intellectual Property Risks of Technological Innovation Service Platforms of China and the Countermeasures Thereof

摘要:

知识产权对科技创新成果的权利归属、利益分配以及维系创新可持续性发挥着重要作用。知识产权保护有利于巩固和发展科技创新。作为科技创新活动的重要载体,科技创新服务平台也涉及知识产权问题。本文分析了我国科技创新服务平台的知识产权风险,并基于对国外相对成熟的科技创新服务平台(InnoCentive)的知识产权保护机制的深入剖析,针对我国科技创新服务平台的知识产权风险,提出了设置弹性的身份认证制度、制定针对性的知识产权的保护条例、建立安全的线上信息交流渠道以及制定明确的利益制度等建议。

Abstract:

Intellectual property plays an important role in the ownership of rights, the distribution of benefits and the sustainability of technological innovation. Intellectual property protection is conducive to consolidating and developing technological innovation. As an important carrier of technological innovation, the technological innovation service platform also involves the protection of intellectual property rights. This paper analyzes the risks of intellectual property of technological innovation service platforms of China and puts forward a series of suggestions for such risks based on the in-depth analysis on the intellectual property right protection mechanism implemented by the InnoCentive, a mature service platform for technological innovation, including setting elastic identity authentication system, formulating specific rules for the protection of intellectual property rights, establishing safe channels for online information exchange, and clarifying the system specifically for the benefit distribution.
