中美知识产权纠纷对我国技术密集型产品出口的影响研究--基于337调查的视角

摘要:

为了研究中美知识产权纠纷对我国技术密集型产品出口所产生的影响。文章基于337调查这一重要的知识产权纠纷形式,分析中国技术密集型产品在对美出口过程中遭遇的337调查的现状,频繁遭遇337调查的主要原因。在此基础上,分析知识产权纠纷给中国技术密集型产品出口所带来的影响。研究结果显示：337调查对中国向美国出口技术密集型产品有抑制作用。对不同研究密集度的技术密集型产品出口均有显著的负作用。其中,对高研究密集度的技术密集型产品出口的抑制效果最为明显。另外,337调查对不同类别的技术密集型产品对美出口存在不同程度的抑制作用。且对第七类和第十六类技术密集型产品的出口的抑制作用最大。最后基于研究结论提出对策建议。

Abstract:

In order to study the impact of Sino-US intellectual property rights disputes on China’s export of technology-intensive products. Based on the section 337 investigation, an important form of intellectual property disputes, this article analyzes the current status of section 337 investigations encountered by Chinese technology-intensive products during export to the United States, and the main reasons for frequent section 337 investigations. On this basis, the article analyzes the impact of intellectual property disputes on China’s export of technology-intensive products. The results show that the section 337 investigation has an inhibitory effect on China’s export of technology-intensive products to the United States. It has a significant negative effect on the export of technology-intensive products with different research intensities. Thereinto the effect of restraining the export technology-intensive products with high research-intensive is most obvious. In addition, the section 337 investigation has different degrees of inhibition on different types of technology-intensive products. Moreover, it has the largest restraint on the exports of the seventh and sixteenth technology-intensive products.
