Risk Regulation in the Field of Human Genetic Resources

国际上对人类遗传资源的界定分为两种类型,但其保护制度殊途同归。政府和私主体在该领域规制中都发挥重要作用,协议是私主体规制中必不可少的内容。相对于政府,私主体一方面是被规制对象,另一方面又通过各种行为迫使政府调整规则。人类遗传资源领域中的规制规则包含法与指导原则、标准。人类遗传资源的规制应当走向合作治理,充分发挥公权力、私主体的积极作用,同时法院也应当积极对行政机关作出行政决策的程序进行合法性审查。

Abstract:

The definition of human genetic resources in the world is divided into two types according to whether it contains data information. Both the government and private bodies play an important role in the regulation of human genetic resources. Compared with the government, the private subject is the regulated object on the one hand, and on the other hand puts pressure on the government through various behaviors to force it to adjust the rules. The regulation rules in the field of human genetic resources contain laws, guiding principles and standards. The regulation of human genetic resources should move towards cooperative governance and give full play to the positive role of public power and private subjects. Meanwhile, the court should also actively examine the legitimacy of administrative decision-making procedures of administrative organs.
