专利价值的衡量是困扰国内外知识产权界的难题。随着企业专利数量的增多,企业管理人员需要一种可操作性地评估专利价值的方法,以有效地控制成本,提高运营能力,实现专利工作的可持续。本文作者认为,作为一个法律授予的权利,专利的价值在于专利权人是否能够有效的行使该权利。行使专利权一般包括实施或许可专利权以及防止他人侵权。对于后者,影响的因素包括专利权的保护范围,专利权的稳定性(即是否容易被无效)以及他人是否能够通过设计规避专利权。本文通过两个案例的分析,分别从专利无效和专利规避角度考察专利的特性,由此提供一个透视专利价值的新视角,从而为企业可操作地评估专利价值提供新的思路。

The estimation of patent value is a problem for the intellectual property field at home and abroad. With the increasing number of enterprise patents, companies need an operable evaluation of patent value to effectively control the cost, improve the operation, and make the patent work sustainable. The main idea of this research is that the value of patent resides in how patentees use their patent rights, including licensing patent and preventing patent infringement. This research focuses on the later one: the prevention scope of patent rights, the possibility of patent being neutralized, and the possibility of hedging the patent enforcement by product designing. By analyzing the self-timer stick patent and the swipe-to-scroll patent, this research gives insights on how to understand the value of patents and how to estimate it for companies.
