区块链与司法的深度融合是我国在全球范围内率先做出的技术应用创新,本质上是区块链自身的技术特征与我国司法的价值追求的内在契合和相得益彰,包括数据真实与司法公信相契合、智能合约与司法高效相契合、数据可信与司法便民相契合、分布式共识与司法分权相契合。与司法的深度融合使司法区块链完全区别于一般意义上的区块链技术,过去对于区块链技术在法律层面可能引发的应用风险和监管盲区的认识对司法区块链都不再成立。

Abstract:

The deep integration of blockchain and justice is the first technological application innovation made by China in the world, which is essentially the inherent match and mutual complement of the blockchain"s technical characteristics and the value pursuit of China"s justice, including the match of data authenticity and judicial credibility, the match of smart contracts and judicial efficiency, the match of data credibility and judicial convenience, the match of distributed consensus and judicial decentralization. The in-depth integration with the judicial system makes the judicial blockchain completely different from the blockchain technology in general. The current understanding of the application risks and regulatory blind spots that may be caused by the blockchain technology may no longer work.
