《欧洲气候法》对我国完善绿色技术创新监管制度的启示

摘要:

2020年10月29日中共中央十九届五中全会公报指出科技创新在国家现代化建设全局中居于核心地位,绿色技术创新是实现建设美丽中国,推动绿色发展的重要途径,但目前我国尚未建立完善的绿色技术创新体系,也缺乏有效的监管制度。2020年3月出台的《欧洲气候法》开创性地提出关于气候变化和绿色发展的监管立法,我国可以从中借鉴有益的经验,在国家层面制定专门立法,建立绿色技术创新的基本制度；通过实施阶段性报告制度对全程进行及时监管；设立专门监管机构,构建信息平台,对施策进展进行评估；完善信息披露制度,促进公众参与,建立多元化监督机制。

Abstract:

On October 29, 2020, the communique of the Fifth Plenary Session of the 19th Central Committee of the Communist Party of China pointed out that scientific and technological innovation is at the core of the national modernization construction, and that green technology innovation is an important way for the country to build a beautiful China and promote green development. The European Climate Law, introduced in March 2020, pioneered regulatory legislation on climate change and green development, which provided a useful reference for our country. China should formulate special legislation at the national level, establish the basic system of green technology innovation, supervise the whole process through the implementation of the phased reporting system, set up a special regulatory agency, decentralize the right to evaluate and review, build an information platform, evaluate the progress of the implementation of the policy, improve the information disclosure system, promote the public participation and establish a diversified supervision mechanism.
