不同类型专利权人的专利失效影响因素研究

摘要:

目的 分析不同类型专利权人的专利失效影响因素,为专利维持时间和失效风险的预测提供依据。方法 选择江苏省2010年申请并获得授权的发明专利作为研究对象,划分为个人组、院校组和企业组,以专利失效为结局变量,采用多因素COX回归模型分析不同组专利失效的影响因素。结果 企业组专利有效率明显高于个人组和院校组,多因素COX回归结果显示,审查周期是三组专利失效的保护因素；延伸申请是个人组和院校组专利失效的保护因素,是企业组专利失效的危险因素。结论 不同类型专利权人的专利失效影响因素存在显著差异。

Abstract:

[Purpose] Analyzing the influencing factors of ineffective patent of different types of patentees to provide the basis for the prediction of maintenance time and ineffective risk. [Method] The authorized invention patents filed in Jiangsu province in 2010 were selected as the research objects, which were divided into individual group, college group and enterprise group. Taking ineffectiveness as outcome variable, the influencing factors of ineffective patent of different groups were analyzed by COX regression analysis. [Result] Effective ratio of enterprise group was significantly higher than that of individual group and college group. COX regression results indicated that examination period was a protective factor for the three groups, extension application was a protective factor for individual group, college group but for enterprise group it was a risk factor. [Conclusion] There were significant differences on influencing factors of ineffective patent of different types of patentees.
