产业集群视角下LED产业专利联盟组建和治理路径研究

Establishment and Governance Path of LED Industry Patent Alliance: Industrial Cluster Perspective

摘要:

为了解决国内产业专利联盟结盟的困境，本研究从产业集群理论和集群产业知识产权治理视角探讨产业集群理论应用于指导专利联盟组建和治理的适宜性。研发回溯了LED产业专利联盟（LPA）组建历程，研究发现LED产业专利联盟发挥了产业集群主管部门的协同作用，降低了产业进行专利联盟协议缔结、核心专利筛选和利益分配博弈的复杂程度，优先瞄准解决共性问题。联盟秘书处开展的理清产业价值链、完善内部网络制定、建立服务生态系统、建立培训服务体系和设立产业专利数据库的活动，成为集群企业参加专利联盟、完善内部治理的主要因素。

Abstract:

This study aims to solve the dilemma of the patent alliance of domestic industrial , the study analysis the suitability of the formation and governance of patent alliance based on industrial cluster theory and cluster industry intellectual property right management. We review the development of LED Industry Patent Alliance (LPA),the result finds that the industry cluster authorities play a leading part, and focus on reduces the complexity of the industry's patent alliance agreement, core patent screening and benefit distribution game, and gives priority to solving industry common problems. The activities carried out by the Secretariat of the LPA to clarify the industrial value chain, improve the internal network formulation, establish the service ecosystem, establish the training service system and set up the industrial patent database have become the main factors for the cluster enterprises to participate in LED Industry Patent Alliance.
