Abstract:Compared with traditional business risk, patent litigation risk, especially patent infringement litigation risk, is more harmful to enterprises. In order to guarantee the judicial protection of patent and the scientific and technological innovation of market subjects in China, this paper analyzes the research hotspots and evolution trends of patent litigation in China by using CiteSpace software based on 383 core documents on patent litigation in CNKI database from 1994 to 2020, and analyzes and predicts the frontier. The findings show that the domestic early related studies began to increase from 2004 and reached the peak in 2016, which was greatly influenced by policies and hot cases; the research sequence is divided into three stages, including basic theory of patent litigation, patent strategy, non-practicing entity and application of patent litigation information, etc; the hot topics are patent litigation, patent infringement litigation and patent infringement, with many research perspectives, but the core author group has not yet been formed. Furthermore, it proposes to build relevant theoretical research framework suitable for China in the field of patent litigation, strengthen cooperative research in other fields, strengthen patent risk management and patent litigation information analysis and utilization of enterprises, and focus on the measures to deal with patent litigation that enterprises may encounter in the process of going abroad.
