Abstract:Digital technology is promoting the development of the social economy and technology in a more open, efficient, and intelligent way. The healthy development of the digital economy requires in-depth understanding and macro-control of new technological innovation. This article analyzes the deficiencies of the current intellectual property system in the Chinese digital economy environment and compares it to foreign counties’ digital economy strategies and legislation. According to the present research, in the field of copyright, digital technology has caused problems such as the proliferation of online infringements and difficulties in safeguarding rights; in the field of patents, digital technology has caused problems such as explosive growth of patents, patent thickets, and insufficient patent protection. This article proposes that China needs to establish a special property rights protection system for data, the most basic element of the digital economy. Finally, this article puts forward countermeasures and suggests that China should promote the specific legislation of the Digital Economy Law revise intellectual property laws, and formulate a digital economy strategy at the national level.
