双方复审程序是中国企业应对海外专利侵权风险的有效手段。揭示影响双方复审程序审查决定的因素,可以引导中国企业制定有效的海外专利侵权风险应对策略。以2012-2020年中国企业在美国涉及的双方复审程序案件为研究对象,基于专利生命周期视角探讨技术研发投入、专利撰写属性、专利授权属性、专利运营状况、双方复审程序当事人类型等因素对双方复审程序审查决定的影响。进而针对双方复审程序审查决定的影响因素提出应对海外专利侵权风险的对策建议。

Inter Partes Review(IPR) is a most effective coping mechanisms to overseas intellectual property risk. The key features which influence the examination result of IPR can guide Chinese enterprises to formulate effective countermeasures in coping with overseas intellectual property risks. Appling with theoretical analysis method, a regression analysis method to the cases of IPR which related to Chinese firms between 2012 to 2020 is introduced. This paper constructs regression models and researches the key features including patent drafting attributes, R D investment attributes, patent authorization attributes, patent operation status and types of related party based on the examination of IPR in patent lifecycle perspective. Therefore, coping mechanisms to overseas intellectual property risk are given based on the key features of Inter Partes Review.
