    摘要:

    知识产权强国是以市场为导向促进科技强国建设、实现经济高质量发展的关键路径。专利质量和价值是创新驱动发展和知识产权强国建设的核心要素。进入新发展阶段,专利工作的发展方向从注重数量增长向提升质量和价值转变。专利质量表现为专利权利要求有效的排他性程度,专利价值表现为专利运用中形成的竞争优势、获得的经济利益。通过专利侵权诉讼案件实证考察专利质量和价值的现状及存在的问题,在对专利质量、专利保护和专利价值厘清认识的基础上,提出提升专利质量和价值的路径和措施,为知识产权强国建设提供有益参考,以进一步促进科技成果转化,更好服务创新驱动发展战略。

    Abstract:

    Intellectual Property Powerhouse is a critical path in promoting the construction of science and technology power and achieving high-quality economic development in the principle of market orientation. Patent quality and value is a primary embodiment of Innovation-Driven Development and Building an IP Powerhouse. At a new development stage, direction of the patent work is transforming from the pursuit of quantity to the improvement of quality and value. Patent quality manifested as the degree of exclusivity of patent claim, and patent value manifested as diversified economic interests obtained by the extraordinary competitive advantage on the Smallest Salable Patent-practicing Unit. Through the intellectual property protection case study empirically investigate the current situation and existing issues of the quality and value of patent, based on the scientific cognition of patent quality, patent protection and patent value, and makes some suggestions to improve the quality and value of patent, and provide a useful reference for building an IP powerhouse to further promote the transformation of scientific and technological achievements, and better serve the Innovation-Driven Development Strategy.
