摘要:

面对日益严峻的国际竞争局势,加强知识产权与标准的融合,对于破解我国知识产权“多而不优、大而不强”的局面、提升我国标准的供给能力至关重要。本文通过剖析我国知识产权与标准融合方面研究现状及问题,研究知识产权与标准的相互作用机理,提出知识产权与标准融合概念的内涵和外延,分析知识产权与标准融合的内外部因素构成,并构建知识产权与标准融合概念模型,最后提出推进知识产权与标准融合的政策建议,以期为我国创新战略的实施提供技术支撑。

Abstract:

Intellectual properties and standards are important means to demonstrate China"s technological strength and enhance China"s international competitiveness, as well as an important means for enterprises to enhance their core competitiveness and expand their influence. In the face of the increasingly severe international competition situation, strengthening the integration of intellectual properties and standards is crucial for solving the situation of "large but low quality, large but not strong" of China"s intellectual properties and improving the supply capacity of China"s standards. Based on the systematic review of the collected findings, this study proposes a fusion model to figure out the mechanism of integration of intellectual properties and standards. First, we analyzed relative researches. Second, we analyze the differences between intellectual properties and standards from the aspects of legal attributes, technical level and openness, and analyze the relationship between intellectual properties and standards from the aspects of being the same carrier of knowledge. We analyzed the relationship between intellectual property and standards. Then, we proposed the intension and extension of the concept of integration of intellectual properties and standards. Third, we divide factors into internal factors and external factors according to their scope of action. Then we built a conceptual model for the integration of intellectual properties and standards. Finally, policy suggestions are put forward to promote the integration of intellectual properties and standards.
