文章探讨数字经济对区域创新能力的驱动机制，以中国省域个体为样本，从知识产权保护角度并引入数据要素市场化构建了一个有调节的中介效应模型。结果发现：数字经济显著促进区域创新能力发展，并具有非线性特征；机制检验表明，数字经济可以通过提高区域知识产权保护水平作用于区域创新能力；数据要素市场化负向调节于数字经济对区域创新能力的直接预测作用，正向调节于知识产权保护的中介前半路径；进一步研究得出，区域知识产权的发展优势将转化为数字经济拉动区域创新能力的动能，且拉动效应在东部地区最强，中部次之，西部最弱。研究揭示了数字经济对区域创新能力的影响规律，为区域创新能力标准体系建设提供理论和政策启示。

This paper discusses the driving mechanism of digital economy on regional innovation capability. Taking Chinese provincial individuals as a sample, from the perspective of intellectual property protection and the introduction of data element marketization, this paper constructs a regulatory intermediary effect model. The results show that digital economy significantly promotes the development of regional innovation capability, and has nonlinear characteristics; The mechanism test shows that digital economy can play a role in regional innovation capability by improving the level of regional intellectual property protection; The negative adjustment of data element marketization is the direct prediction of digital economy on regional innovation capability, and the positive adjustment is the first half of the intermediary path of intellectual property protection; Further research shows that the development advantage of regional intellectual property rights will be transformed into the driving force of digital economy to promote regional innovation capability, and the pull effect is strongest in the eastern region, followed by the central region, and weakest in the western region. The research reveals the influence of digital economy on regional innovation capability, and provides theoretical and policy enlightenment for the construction of regional innovation capability standard system.
