法制化视阈下完善科技伦理治理机制研究

Research on Perfecting the Governance Mechanism of Science and Technology Ethics from the Perspective of Legalization

摘要:

科技伦理治理法治化水平是满足对科技研发、设计的“上游”进行原则性、程序性规制需要，能够为科技活动划定边界，有效回应并规范涉及科技应用行为，有利于推动负责任的科技创新与应用。因此，在解决科技发展过程中面临的伦理困境时，要从法制化建设进程中进行科技伦理治理的探究与反思。本文立足于法律治理与科技治理的关联性，吸收借鉴过往经验，以适法制化化作为切入点，从实体化权利义务、多层次规范体系的构建等角度出发，采取有效方法举措，进一步健全完善科技伦理治理机制，增强伦理治理效能。

Abstract:

The level of legalization of scientific and technological ethical governance is to meet the needs of principled and procedural regulations on the "upstream" of scientific and technological research and development and design. It can delineate boundaries for scientific and technological activities, effectively respond to and regulate behaviors related to scientific and technological applications, and is conducive to promoting responsible scientific and technological innovation and application. Therefore, when solving the Ethical dilemma faced in the process of scientific and technological development, we should explore and reflect on the ethical governance of science and technology in the process of legal construction. This article is based on the correlation between legal governance and technological governance, drawing on past experience and using legalization as the entry point. Starting from the perspectives of substantive rights and obligations, and the construction of a multi-level normative system, effective methods and measures are taken to further improve the mechanism of technological ethical governance and enhance the effectiveness of ethical governance.
