传统中医药的保护是多方位、全方面的，而对其知识层面的保护是其进步和发展的关键因素之一。现有知识产权体系因其特性并不能于高度契合于我国传统中医药知识保护。对此，一方面要充分利用知识产权制度以发挥其在保护传统中医药知识层面的最大效用，另一方面要善于发掘知识产权在传统中医药知识保护领域的上位权利及关联性权利的保护效用，方能为我国传统中医药知识的保护寻得更为广阔的法律制度空间。

Abstract:

The protection of traditional Chinese medicine is multi-faceted and all-encompassing, and the protection of its intellectual dimension is one of the key factors in its progress and development. The existing intellectual property rights system, due to its characteristics, is not highly suitable for the protection of Chinese traditional medicine knowledge in China. In this regard, on the one hand, we need to fully utilize the intellectual property system to maximize its effectiveness in protecting traditional Chinese medicine knowledge, and on the other hand, we need to explore the protection effectiveness of upper intellectual property rights in the field of traditional Chinese medicine knowledge protection, together with related rights, in order to find a broader space for the legal protection of traditional Chinese medicine knowledge in China.
