Abstract:China usually adopts a "three-step approach" for patent inventive judgment, however, under-explaining the factors required for each step in patent examination guidelines, leading to some subjectivity when judging is obvious or not. UK adopts a "four-step approach" for patent inventive judgment, in which the inventive concept is explicitly mentioned, with certain reference significance. This paper starts from the inventive judgment method in China and UK patents to find out the similarities and differences, and analyzing the connotation of the inventive concept and its effect in creative judgment, a specific method of operation for making inventive judgment using the inventive concept in a "three-step process" is given. At the same time, two practical cases are combined to explain the influence of inventive concept on the result of inventive judgment. Integrating the inventive concept into each step of the "three-step process" , which will help to make a more objective and fair judgment on the creativity of the patents.
