基于专利权确权规则下数据知识产权的确权研究

数据资源作为一种特殊知识产权,面临的首要和关键问题是数据知识产权确权。虽然目前采用了诸如区块链、加密、可信计算等技术实现了数据“确权”,但是仍无法解决数据确权作为数据资产运用全过程中的难点及问题,不能有效适应社会中数据持有权人、加工使用权人、数据产品经营权人的实际需要和利益保障。为促进数据资源市场可持续发展有序,解决数据资产确权问题,本文借鉴专利权确权思路提出数据确权的新的解决路径。

Abstract:

As a special type of intellectual property, data resources face the primary and key issue of data intellectual property rights confirmation. Although technologies such as blockchain, encryption, and trusted computing have been used to achieve data ownership, they still cannot solve the difficulties and problems in the entire process of using data ownership as a data asset, and cannot effectively adapt to the actual needs and interests of data holders, processing and usage rights holders, and data product management rights holders in society. In order to promote the sustainable and orderly development of the data resource market and solve the problem of data asset certification, this article draws on the idea of patent certification to propose a new solution path for data certification.
